Our Refund & Warranty Policy

 

Refund Policy
 

At Cypress Grove Technologies LLC, we are committed to customer satisfaction. If a purchase is not satisfactory, refunds will be given as follows:

 

  1. For services pursuant to an annual contract, pro rated refund for cancellations made within 30 days of the service commencement date. The refund will be based on one full month usage and billing. Any material or media delivered to the customer must be returned to us complete, in its original packaging and condition.

  2. For third party software purchased pursuant to our recommendation, full refunds within 30 days. The product must be returned to us complete, in its original packaging and condition with all media and manuals.

  3. For any equipment purchased pursuant to our recommendation, full refunds within 30 days. The product must be returned to us complete, in its original packaging and condition together with all media and manuals.

  4. For hardware or third party software purchased at the request of the customer, any refund will be based on the refund policy of the software vender from whom the product was purchased. The product must be returned to us complete, in its original packaging and condition with all media and manuals.

Equipment Warranty Policy
 

Cypress Grove Technologies LLC is not an equipment manufacturer. All equipment supplied is purchased from other venders. Any warranty claims for repair or replacement of new equipment shall be governed by the policies of the equipment manufacturer or vendor as appropriate. Cypress Grove Technologies LLC will process the claim on behalf of the customer, and make its best efforts to successfully resolve the claim, but the final decision shall remain the responsibility of the said manufacturer or vendor, and Cypress Grove Technologies LLC undertakes no liability for any warranty claims.

 

Equipment which is sold by Cypress Grove Technologies LLC as refurbished or used is warranted by Cypress Grove Technologies LLC to be free from defects in materials and workmanship for 6 months under normal use and service, normal wear and tear excepted, from the date such product is actually sold to the Buyer; Cypress Grove Technologies LLC shall have no obligation under this warranty or otherwise, if the product is improperly installed, applied or maintained outside of stated operating parameters, altered or improperly serviced or repaired by anyone other than Cypress Grove Technologies LLC or if damage is caused by outside natural occurrences, such as lightning, power surges or the like. In addition, this warranty shall not apply to defects resulting from unauthorized modification, misuse, vandalism, fire, floods, acts of nature, or alterations of serial numbers or failures related to batteries of any type used in connection with other products sold hereunder.

EXCLUSION OF WARRANTIES, LIMITATION OF LIABILITY
 

THERE ARE NO WARRANTIES, EXPRESS OR IMPLIED, OF MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE OR OTHERWISE, WHICH EXTEND BEYOND THE DESCRIPTIONS HEREIN. IN NO CASE SHALL CYPRESS GROVE TECHNOLOGIES LLC BE LIABLE TO ANYONE FOR ANY CONSEQUENTIAL OR INCIDENTAL DAMAGES FOR BREACH OF THIS OR ANY OTHER WARRANTY, EXPRESS OR IMPLIED, OR UPON ANY OTHER BASIS OF LIABILITY WHATSOEVER, EVEN IF THE LOSS OR DAMAGE IS CAUSED BY ITS OWN NEGLIGENCE OR FAULT AND EVEN IF CYPRESS GROVE TECHNOLOGIES LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSSES OR DAMAGES. ALL SOFTWARE, IF ANY, IS SOLD “AS IS” AND WITHOUT WARRANTY OF ANY KIND. CYPRESS GROVE TECHNOLOGIES LLC EXPRESSLY DISCLAIMS ALL WARRANTIES EXPRESS OR IMPLIED ON SOFTWARE, INCLUDING BUT NOT LIMITED TO, NONINFRINGEMENT OF THIRD PARTY RIGHTS, AND ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. CYPRESS GROVE TECHNOLOGIES LLC DOES NOT WARRANT THAT THE FUNCTIONS CONTAINED IN THE SOFTWARE WILL MEET BUYER’S REQUIREMENTS, OR THAT THE OPERATION OF THE SOFTWARE WILL BE UNINTERRUPTED OR ERROR-FREE. BUYER EXPRESSLY UNDERSTANDS AND AGREES THAT CYPRESS GROVE TECHNOLOGIES LLC DOES NOT WARRANT THAT THE PRODUCT OR SOFTWARE IS FREE OF CLAIMS OF INTELLECTUAL PROPERTY INFRINGEMENT BY ANY THIRD PARTY. CYPRESS GROVE TECHNOLOGIES LLC HEREBY DISCLAIMS ANY SUCH WARRANTY OR INDEMNIFICATION AGAINST INTELLECTUAL PROPERTY INFRINGEMENT, INCLUDING BUT NOT LIMITED TO PATENT, TRADEMARK, COPYRIGHT OR TRADE SECRET INFRINGEMENT.
